O ‘rito de ofício’ a ser aplicado pelos julgadores possui propriedades eficazes para prevenir soluções alheias à realidade dos casos apresentados nos tribunais, afastando eventuais derrames imaginativos aos quais todos estamos sujeitos. Some-se a isso que a virtude da temperança é vertiginosamente deixada de lado e sem ela a Justiça não se realizará jamais. Estes alertas apontam para o cuidado que se deve ter durante a análise dos casos, banindo as vertentes de significações alienadas que corrompem a convicção do interpretante. (...) A ideia da condição polissêmica remete à perda do espeque do signo, o que provoca a abertura de acepções díspares e fundamentadas em fatores repertoriais particulares, e que pode destoar do fato concreto. A base semiótica legada por Peirce e a herança de Fichte para o Direito, abordada segundo o respectivo sistema de seu idealismo, auxiliarão na investigação de um contexto coeso para este estudo. Assim, imprescindível a compreensão de que as interpretações, quando ocorrem com os ecos polissêmicos em relação aos objetos de processos judiciais, representam um equívoco deteriorante no exercício judicativo, o que se deve evitar. This article deals with three elements that are related to my Ph.D. research — early Christianity, apocalyptic literature and gnosis — and their reception in contemporary public space. Specific examples are given that confirm the contemporary world’s survival interest in religions, including early Christianity, apocalyptic belief systems and gnosis. The text also discusses certain manifestations of this interest provided by works of fiction and books whose authors are not always aware of serious academic research in these fields. Randomization is an integral part of well-designed statistical trials, and is also a required procedure in legal systems. Implementation of honest, unbiased, understandable, secure, traceable, auditable and collusion resistant randomization procedures is a mater of great legal, social and political importance. Given the juridical and social importance of randomization, it is important to develop procedures in full compliance with the following desiderata: (a) Statistical soundness and computational efficiency; (b) Procedural, cryptographical and computational security; (c) Complete auditability and traceability; (d) Any (...) attempt by participating parties or coalitions to spuriously influence the procedure should be either unsuccessful or be detected; (e) Open-source programming; (f) Multiple hardware platform and operating system implementation; (g) User friendliness and transparency; (h) Flexibility and adaptability for the needs and requirements of multiple application areas (like, for example, clinical trials, selection of jury or judges in legal proceedings, and draft lotteries). This paper presents a simple and easy to implement randomization protocol that assures, in a formal mathematical setting, full compliance to the aforementioned desiderata for randomization procedures. Mozambique has seen remarkable growth in biomedical research over the last decade. To meet a growing need, the National Committee for Bioethics in Health of Mozambique encouraged the development of ethical review processes at institutions that regularly conduct medical and social science research. In 2012, the Faculty of Medicine of University Eduardo Mondlane and the Maputo Central Hospital established a joint Institutional Committee on Bioethics for Health. This study examines the experience of the first 4 years of the CIBS FM (...) & MCH. This study provides a descriptive, retrospective analysis of research protocols submitted to and approved by the CIBS FM & MCH between March 1, 2013 and December 31, 2016, together with an analysis of the Committee’s respective reviews and actions. A total of 356 protocols were submitted for review during the period under analysis, with 309 protocols approved. Sixty-four percent were submitted by students, faculty, and researchers from UEM, mainly related to Master’s degree research. Descriptive cross-sectional studies were the most frequently reviewed research. The majority were prospective and used quantitative methodologies. The Departments of Internal Medicine at MCH and Community Health at the FM submitted the most protocols from their respective institutions, with 38 and 53% respectively. The CIBS’s average time to final approval for all protocols was 56 days, rising to 161 for the 40 protocols that required subsequent national-level review by the CNBS. Our results show that over its first 4 years, the CIBS FM & MCH has been successful in managing a constant demand for protocol review and that several broad quality improvement initiatives, such as investigator mentoring and an electronic protocol submission platform have improved efficiency in the review process and the overall quality of the protocols submitted. Beyond Maputo, long-term investments in training and ethical capacity building for CIBS across the country continue to be needed, as Mozambique develops greater capacity for research and makes progress toward improving the health of all its citizens. Kant denuncia el mal como realidad existente, no meramente lógica, cuyo carácter negativo proviene de su oposición al deber moral. Kant nos va a decir que el mal es contraposición real, no simplemente una carencia. Este carácter ontológico del mal pone en tela de juicio la visión moderna del Progreso: éste no es el desenlace natural del devenir humano, ya que es posible (...) también progresar en el mal, como abundante ha probado la historia, incluso la reciente. De ahí la necesidad de replantearse el ser del hombre, a la luz de su responsabilidad trascendental. Si hay razones para el optimismo, no descansan en una fe ciega en el hombre, sino en su capacidad moral para superar su propia inclinación al mal. In opposition to the scholastic view dominant until the 18"' Century, that evil was but the absence of being, Kant maintains chat evil is actual reality, not merely logical, and that its negate character lies in its opposition co moral duty. Kant asserts that evil is real contrariety, not simply deficiency. In van Benthem (2008), van Benthem proposes a dynamic consequence relation defined as${\psi _1}, \ldots,{\psi _n}{ \models ^d}\phi \,{\rm{iff}}{ \models ^{pa}}[{\psi _1}] \ldots [{\psi _n}]\phi,$where the latter denotes consequence in public announcement logic, a dynamic epistemic logic. In this paper we investigate the structural properties of a conditional dynamic consequence relation$\models _{\rm{\Gamma }}^d$extending van Benthem’s proposal. It takes into account a set of background conditions Γ, inspired by Makinson (2003) wherein Makinson calls this reasoning ‘modulo’ a set Γ. In the (...) presence of common knowledge, conditional dynamic consequence is definable from (unconditional) dynamic consequence. An open question is whether dynamic consequence is compact. We further investigate a dynamic consequence relation for soft instead of hard announcements. Surprisingly, it shares many properties with (hard) dynamic consequence. Dynamic consequence relations provide a novel perspective on reasoning about protocols in multi-agent systems. (shrink)

Resumo: Por intermédio da análise dos gêneros carta e conto escritos por Machado de Assis, procuramos oferecer uma resposta à questão do horizonte ético e moral que opera nos textos do autor. Trabalhamos numa perspectiva interdisciplinar, pois dialogamos com filósofos, historiadores e críticos literários procurando, num primeiro momento, demonstrar que a noção de cuidado de si se mostra na correspondência machadiana a partir da perspectiva de cura de si, isto é, um tipo de sabedoria dos antigos gregos e romanos que (...) o autor lança mão para realizar e organizar o pensamento literário, seu e de seus pares, na direção das publicações e conquistas no âmbito da literatura. Num segundo momento, demonstramos que o cuidado de si terá outro sentido nos textos de ficção, pois se volta para um cuidado da alma no sentido do desenvolvimento do pensamento crítico do sujeito em relação ao eu e ao outro, ao indivíduo e ao mundo social. The care of the self as an ethical perspective in Machado de Assis Abstract : Through the analysis of the genres letter and short story written by Machado de Assis, we try to offer an answer to the question of the ethical and moral horizon that operates in the author's texts. We work in an interdisciplinary perspective, as we dialogue with philosophers, historians and literary critics, trying, in a first moment, to demonstrate that the notion of self-care is shown in Machado's correspondence from the perspective of self-cure, that is, a kind of wisdom from the ancient Greeks and Romans that the author uses to accomplish and organize the literary thought, his own and his peers', in the direction of publications and achievements in the field of literature. In a second moment, we demonstrate that the care of the self will have another meaning in fiction texts, since it turns to a care of the soul in the sense of the development of the subject's critical thought in relation to the self and to the other, to the individual and to the social world. Cet article traite de christianisme ancien, de littérature apocalyptique et de gnose, trois champs de recherche liés à ma recherche doctorale, dans le but de discuter de leur réception dans l’espace public contemporain. Les différents exemples donnés dans ce texte montrent bien que cet espace public contemporain est toujours friand de sujets religieux, en particulier dans les domaines cités. Il est vrai que cet intérêt a été moussé par des ouvrages de fiction et des livres qui utilisent le christianisme comme (...) arrière-plan, mais sans être au courant des recherches actuelles. Le rôle du chercheur en sciences des religions apparaît donc crucial et reste au centre de l’ensemble des considérations réunies ici. (shrink)

Para intentar comprender la visión que Eugenio d'Ors tiene de España a principios de los años 30 del pasado siglo, es necesario entender su biografía. Cuando Eugenio d’Ors deja Barcelona en julio de 1921 solo le faltaban tres meses para cumplir los cuarenta años. A los cuarenta —escribió su hijo Álvaro— lo más normal es que los hombres no cambien ya su caudal de ideas. La originalidad de la época catalana sobre el resto de la producción de d'Ors no significa, (...) sin embargo, un menosprecio de los años posteriores. Fue en gran medida su producción no catalana y su constante actividad y participación en muchos otros proyectos españoles y europeos, lo que hizo que su “gloria catalana” no quedara diluida y que su figura tenga hoy un lugar destacado en las letras españolas. Por todo ello, la exposición está organizada en las tres secciones siguiente: 1) Su biografía catalana; 2) la primera etapa de su biografía castellana, y 3) Su visión de España en los años 30. Prior research indicated that resistance to consumption contributes to the achievement of sustainable development goals and is associated with higher well-being. We investigate conditions under which materialists intend to resist consumption. We find that by enhancing self-control and long-term orientation, the intention to resist consumption and the frugality scores of high- and low-materialism individuals increase. These increases are stronger for those who believe that possessions are a source of happiness, but not for those who believe that possessions signal success or (...) for those who believe that acquiring possessions is a central goal in their daily lives. The findings suggest that individuals who believe that possessions are a source of happiness and who are led to feel more self-controlled and long-term oriented become inclined to resist consumption in the short-term to achieve materialistic aspirations in the long-term. Similar findings were not obtained for the other dimensions of materialism because these dimensions do not motivate one to save in the short-term. Overall, these studies demonstrate that the happiness dimension of materialism may also motivate resistance to consumption. Such findings have implications for sustainability, for public policy makers, and for business ethics. (shrink)

J.-C., est due à Komis, prêtresse de Livie. Gravée sur la façade arrière du portique Nord-Ouest, elle était la dédicace de l'exèdre des abords Ouest de l'agora. La deuxième, complétée par un fragment découvert en 2006, est la dédicace d'une statue pour Agrippa Postumus, fils adoptif d'Auguste honoré comme bienfaiteur par tradition ancestrale. (...) In this work, we shall study structural abduction and how ways of searching for solutions to the corresponding abductive problems could be modeled. Specifically, we shall define modal semantic tableaux for normal modal systems and study its applications to structural abduction. This method even makes structural abduction clearer and, as it shall be seen, when a radical change of logic is epistemologically required, the corresponding tableau will have pertinent information to suggest it.

In recent years, counterfeiting has grown exponentially and has now become a grave economic problem. The acquisition of counterfeits poses an ethical dilemma as it benefits the buyer and illegal seller at the cost of the legitimate producer and with fewer taxes being paid throughout the supply chain. Previous research reveals inconsistent and sometimes inconclusive findings regarding whether materialism is associated, positively or negatively, with intentions to purchase counterfeits. The current research seeks to resolve these inconsistencies by investigating previously ignored (...) interactions between three variables: risk of embarrassment, counterfeit detectability and product conspicuousness. First, risk of embarrassment mediates the relationship between materialism and counterfeit purchase intentions. Specifically, materialism negatively predicts counterfeit purchase intentions as mediated by risk of embarrassment. Second, this relationship only holds when the counterfeit can be easily detected. When it is not easily detected, materialism instead leads to positive purchase intentions. Third, these positive effects can be offset when the product is not highly visible. This research has important implications for marketers, manufacturers and academics and contributes to better understanding the antecedents of counterfeit purchases. (shrink)

The use of airbrushed “thin ideal” models in advertising creates major ethical challenges: This practice deceives consumers and can be harmful to their emotional state. To inform consumers they are being deceived and reduce these negative adverse effects, disclaimers can state that the images have been digitally altered and are unrealistic. However, recent research shows that such disclaimers have very limited impact on viewers. This surprising result needs further investigation to understand how women who detect that images have been airbrushed (...) are still harmed by them. Three studies reported in this article address this question. The authors identify a typology, based on a combination of three emotional reactions experienced by women who are exposed to the airbrushed thin ideal. In further analyses, they investigate how detection of airbrushing—whether spontaneous or with the help of a disclaimer—relates to these emotional reactions and women’s attitudes to altered images. Results show that detection of airbrushing does not systematically protect women from either wanting to look like airbrushed thin models or the negative emotions triggered by exposure to thin ideal images, nor does it always generate defensive reactions toward ads using such images. Women who detect that images have been airbrushed may still process these images as realistic. In addition to discussing this irrational process of self-deception, this article suggests policy interventions to prevent it. (shrink)

This article explores the metaphor of Science as provider of sharp images of our environment, using the epistemological framework of Objective Cognitive Constructivism. These sharp images are conveyed by precise scientific hypotheses that, in turn, are encoded by mathematical equations. Furthermore, this article describes how such knowledge is pro-duced by a cyclic and recursive development, perfection and reinforcement process, leading to the emergence of eigen-solutions characterized by the four essential properties of precision, stability, separability and composability. Finally, this article discusses (...) the role played by ontology and metaphysics in the scientific production process, and in which sense the resulting knowledge can be considered objective. Although logical consistency is desirable in scientific research, standard statistical hypothesis tests are typically logically inconsistent. To address this issue, previous work introduced agnostic hypothesis tests and proved that they can be logically consistent while retaining statistical optimality properties. This article characterizes the credal modalities in agnostic hypothesis tests and uses the hexagon of oppositions to explain the logical relations between these modalities. Geometric solids that are composed of hexagons of oppositions illustrate the conditions for these modalities to be logically (...) consistent. Prisms composed of hexagons of oppositions show how the credal modalities obtained from two agnostic tests vary according to their threshold values. Nested hexagons of oppositions summarize logical relations between the credal modalities in these tests and prove new relations. (shrink)

With this volume of the series Logic, Epistemology, and the Unity of Science edited by S. Rahman et al. a challenging dialogue is being continued. The series’ first volume argued that one way to recover the connections between logic, philosophy of sciences, and sciences is to acknowledge the host of alternative logics which are currently being developed. The present volume focuses on four key themes. First of all, several chapters unpack the connection between knowledge and epistemology with particular focus on (...) the notion of knowledge as resulting from interaction. Secondly, new epistemological perspectives on linguistics, the foundations of mathematics and logic, physics, biology and law are a subject of analysis. Thirdly, several chapters are dedicated to a discussion of Constructive Type Theory and more generally of the proof-theoretical notion of meaning.Finally, the book brings together studies on the epistemic role of abduction and argumentation theory, both linked to non-monotonic approaches to the dynamics of knowledge. The full Bayesian signi/cance test (FBST) for precise hypotheses is presented, with some illustrative applications. In the FBST we compute the evidence against the precise hypothesis. We discuss some of the theoretical properties of the FBST, and provide an invariant formulation for coordinate transformations, provided a reference density has been established. This evidence is the probability of the highest relative surprise set, “tangential” to the sub-manifold (of the parameter space) that defines the null hypothesis.

In this article, we discuss some issues concerning magical thinking—forms of thought and association mechanisms characteristic of early stages of mental development. We also examine good reasons for having an ambivalent attitude concerning the later permanence in life of these archaic forms of association, and the coexistence of such intuitive but informal thinking with logical and rigorous reasoning. At the one hand, magical thinking seems to serve the creative mind, working as a natural vehicle for new ideas and innovative insights, (...) and giving form to heuristic arguments. At the other hand, it is inherently difficult to control, lacking effective mechanisms needed for rigorous manipulation. Our discussion is illustrated with many examples from the Hebrew Bible, and some final examples from modern science. (shrink)

A pesar de lo anterior, la mayor parte de la investigación disponible se concentra en estudios de corte descriptivo y evaluativo, sin conectar sus desarrollos con las reflexiones de la teoría sociológica. El presente ensayo identifica las principales posibilidades teóricas y epistemológicas de la teoría de sistemas sociales para el análisis de la educación superior, examinando los rendimientos de la noción de diferenciación de (...) planos de formación sistémica (interacción, organización y sociedad) y la idea de diferenciación de sistemas parciales especializados. Abstract Higher education has become an object of growing interest in the specialized literature. Despite this, most of the available research concentrates on descriptive and evaluative studies, without connecting its developments with the reflections of general sociological theory. This essay identifies the main theoretical and epistemological possibilities of social systems theory for the analysis of higher education, examining the uses of the notion of differentiation of systemic formation planes (interaction, organization, and society) and the idea of differentiation of specialized partial systems. Sortition, i.e. random appointment for public duty, has been employed by societies throughout the years as a firewall designated to prevent illegitimate interference between parties in a legal case and agents of the legal system. In judicial systems of modern western countries, random procedures are mainly employed to select the jury, the court and/or the judge in charge of judging a legal case. Therefore, these random procedures play an important role in the course of a case, and should comply with (...) some principles, such as transparency and complete auditability. Nevertheless, these principles are neglected by random procedures in some judicial systems, which are performed in secrecy and are not auditable by the involved parties. The assignment of cases in the Brazilian Supreme Court is an example of such a procedure, for it is performed using procedures unknown to the parties involved in the judicial cases. This article presents a review of how sortition has been historically employed by societies and discusses how Mathematical Statistics may be applied to random procedures of the judicial system, as it has been applied for almost a century on clinical trials, for example. A statistical model for assessing randomness in case assignment is proposed and applied to the Brazilian Supreme Court. As final remarks, guidelines for the development of good randomization procedures are outlined. (shrink)

Inauguration speech at chair number 18 of the Brasilian Academy of Philosophy.

In order to present the incidence of the dynamic turn in the logic of scientific research, we begin with a section, in this article, that deals with logical games as triggers of this dynamic turn in contemporary logic, together with the program of logical dynamics of information and interaction. We briefly introduce the main characteristics of the logic favorable to independence and the game-theoretical semantics, of dialogical logic, as well as the essential elements of this program. Although from any of (...) these points of view we have a list of logical tools to deal with more clearly epistemological issues, we highlight the role of dynamic epistemic logic, to which we dedicate the following section. There follows another one in which we enter the logical studies of abduction as one of the fundamental problems of contemporary epistemology and, in a new section, in terms of the theoretical constructs of the preceding sections, we present and explain a phenomenon that emerged in the field of linguistics, the case of the discovery of the Amazonian language pirahã, which should be considered an anomaly within the framework of the Chomskian theory.
